Bruen decision, which took a sledgehammer to the legal structure of quite literally all of the gun control in the country by invalidating means-end scrutiny. What this case was specifically centered around was New York's may-issue permitting scheme, which gave local law enforcement the ability to deny you a pistol permit if you couldn't prove you had an immediate valid need for carry. New York had their dicks slapped in the Supreme Court, and were told that they have to turn over this law, and not base their permitting schemes on subjective review. New York immediately passed a new law in direct defiance of the court, this time creating the subjective standard of proving that you are of good moral character by forcing you to open up your social media history. Second amendment activist groups sue, because subjective standards for pistol permits are now illegal. Rather: If New York wants to keep their new law, they have to prove that it is based off of the text, history and tradition of how the second amendment was applied. Meaning, they need to come up with a precedent for gun control that existed in the time of the founding fathers. New York filed countersuit to dismiss, clinging to what precedent they could. I direct your attention to page 56. "Indeed, New York’s law is far less burdensome than laws the founders enacted, in which a person’s identity or beliefs—including Native Americans, Catholics, loyalists, and followers of certain preachers— presumptively disqualified them for bearing arms. "To translate - it is the official position of the Superintendent of the New York State Police, vetted through the office of the Attorney General of the state of New York and on record in publicly available cort documents, to stand on the precedent of discrimination against Catholics and Native Americans as justification for their current gun control.So, when you tell me that no one's coming for your guns, just remember, this is how desperate these people are for gun control. All sanity has just been openly thrown aside. For fuck's sake, what's conspicuously missing between Catholics and Native Americans speaks just as loudly, especially since the Attorney General of New York is a black woman, and you know damn well she's heard of a thing called slavery.Pleasant day to you.
