Do you support tort reform?

Hello:

Right wingers LOVE tort reform.  They SAY it will bring down medical costs and do away with frivolous lawsuits.. But, let's be clear, here.  Tort reform means LIMITING the amount of money SOMEBODY ELSE will get if they win a lawsuit... Clearly, if you thought you'd be limiting the amount YOU'D get if a doctor MAIMED your child, or a drunk driver killed your husband, you'd NEVER support tort reform..

You have a RIGHT to sue to be made WHOLE.  You SHOULD have that right.  Why on earth would you willingly GIVE it up????

Maybe the maximum amount you can sue for is to fix the problem. If the problem cannot be fixed, then send the guy to jail and prevent him from oracticing ever again. Just saying ;)

Theoretically, that's what the law says.. Damages should make a person WHOLE, not enrich them.. If a hospital screwed your baby up, how would you know how much a LIFETIME of care would cost your family?

Unless, of course, a doctor PURPOSEFULLY hurt your child, he shouldn't be sent to jail.. A NICE, HUGE malpractice verdict against him should PREVENT him from doing it again, because he'll NEVER be able to get malpractice insurance again..

So..., if people are getting more money than it takes to fix the problem then we need reform ;)

I mean, clearly, if you hope to enrich yourself, you'd NEVER support tort reform. ;)

If someone's actions end up killing someone else, they should do jail time. No amount of money is going to make anyone whole ;)

I don't know what the law in the US is but the law in the UK is that is only liable when he takes a decision that is outside that is outside the range of decisions a reasonable doctor would consider. This is how it should stay in my opinion. I have no idea what the reforms are you are talking about though.

It doesnt necessary mean limiting the amount of money someone will get in compensation. Who is proposing that 'reform'? How much do people get now?

Side: yes

No. Tort reform is a catchy way of saying "we want people to not be able to sue as easily". So basically weaken the constitutional safeguard and weaken our legal system. Sure there are frivolous lawsuits. Sure there is a high burden on the court system. But that seems like more of an argument for hiring more judges and building more courts than to prevent people from suing.
