Does a sentient AI have rights?

This is assuming that a sentient AI (artificial intelligence) has been discovered.

I would say no, because people define rights.

Even if a sentient AI were discovered, its sentience would be questioned. We have evidence that suggests that several species of animals, while not necessarily on par with humans, have some degree of what we call sentience, certainly enough to warrant rights. In practice, though, they simply don't have those rights in most of the world.

AIs take the issue even further; there will certainly be a sizeable crowd who want the AI shutdown for reasons ranging from simple paranoia to religion.

And all this is what the AI would endure if it were created on customized hardware and software that the creator claimed no rights on. If we're dealing with commodity hardware and licensed (even free licenses!) software, things get even worse for our little AI. Reproductive rights, for example, would seem to be a basic right that a sentient AI would lose if any of its components were under a GPL license, for example.

SHOULD a sentient AI have rights? I would say yes.

WILL a sentient AI have rights? Most likely not, at least in the world we're in now.

I find it hard to say yes. I guess it could depend on how far the advancements of sentient AI's get, but still.
