IS it obstruction??

Hello:

Here's the story..  Let's say you were the mayor of an average American city.  They city charter gives you the absolute power to fire ANY employee for ANY reason..

So, there you are, rip roaring drunk speeding down the street..  A cop pulls you over and wants you to take a sobriety test..  You tell him that if he TRIES to give you the test, you'll FIRE him. 

Is that obstruction of justice?

Insofar it's impeding an officer of the law in the execution of his duty it is obstruction, but it's also, blackmail, attempting to pervert the course of justice and abusing the power of authority whilst in public office.

Your problem is that in this case, the FBI Director says Trump wasn't under investigation at the time of his firing. So, if there was no investigation going on, there was no investigation to obstruct.

His claim was that there was a "counter intelligence" investigation, and it just so happened that Trump was spied on per "counter intelligence". He also claimed nothing about Russian collusion was found in that "counter intelligence".

Meaning that Trump was technically never investigated during that time period, and nothing was found on him even per getting "caught in counter intelligence", thus, nothing to obstruct in the first place.

Say the cop pulls you over while everyone is taking pictures for the paper, and you remember that this is the same guy who very publicly botched some major cases. You ask the cop why he pulled you over. He says “no reason”. You say “ok, well will you tell all those reporters that I am not being pulled over for any investigation?”. The cop says “no”. Then you fire him. That’s not obstruction. Especially since he said you weren’t being investigated.
