Typically legal fees are lumped into the case for just this purpose.

You usually do, court costs are included in the ruling but I don't know if small claims is the same as the higher courts.

They generally do, already. At least here. People include it in the case file.

As to whether they should, that's decided on a per case basis, of course. Though I don't recall a time when it wasn't.

Hello:

If you had a FEAR of losing your small claims case against your rich landlord because you'd have to pay his legal fees, you probably wouldn't sue him. And, that's EXACTLY why the courts should be accessible to EVERYBODY, poor and rich alike.
