Yes, but she put herself in that state. The thing is that it is only rape if she is not conscious. Even when I am tired, I know what I want and do not want.
Yes, however, is getting a girl drunk due to everyone else doing it any different from having sex because everyone else is doing it? The context doesn't matter. Peer pressure is a reason, not an excuse.
Well, I am responsible for my actions, even when I am tired. Even if when I am tired I am not in a proper state of mind. While tired, if I get into a car accident, I am fully responsible for it since I wasn't in the proper state of mind. Why is it that a girl isn't responsible for her actions while intoxicated if she knowingly intoxicated herself.
Yes. If she did not want it then you raped her. But if she didnt do anything to even show oppression then I wouldnt consider it rape. If she decides to say no or tries to push you away then I would think its still rape.
So, being drunk isn't what makes it rape right? Even though she can't think clearly and is likely to make poor decisions. If she poorly choose to have sex because she was drunk, are you saying that it isn't rape?
You may be on the wrong side of the issue. It seems to me that you don't believe drunkenness is the determining factor which means it is not necessarily rape to have sex with a drunk girl (or guy, though no one cares).
No. I was thinking about if the man was not drunk, and the woman was- that would clearly be rape. If they were both drunk, it is more complicated. If a drunk man is seduced by a sober woman, she is raping him. If a drunk attacks a someone, it doesn't matter if they're drunk or not. Overall, people should not drink themselves out of being able to think properly, but they should also not take advantage of others who are in that state. Maybe being drunk should be a crime?
I would say so. When a person is drunk, they are incapable of logical thinking. A person can easily persuade somebody to engage in sexual activity if that said person is under the influence. I also agree that if both parties are drunk, well then it's not rape, it's bad decision making.
If he is drunk and she is not, he is to blame for drunkenness. If she is drunk and he is not, he's a rapist. Like I said, sounds pretty sexist to me.
If they are equally drunk, then drunkenness isn't the determining factor, consent is. It is possible for them to be equally drunk, equally consenting (in drunkenness), and equally regretting it in the morning. Is this still rape to you?
Because if a man gets himself drunk you say he is at fault. If a woman gets herself drunk you say she's a victim. It's a double standard that is sexist against men since it holds them responsible in an unbalanced way. It's sexist against women because it implies that they are too weak minded to be held equally responsible for their own actions.
it is whether the girl is a little bit conscious or not. the question says a drunk girl and i don't think a drunk girl would be a little bit conscious. why cant the man have sex with the girl when she is fully conscious. the thing is that she is drunk, she doesn't know what she is doing at that time either she tries to refuse it or not.
Without a doubt it is a bad idea, but i don't know if i would go so far to call it rape. a good question to determine this is to ask "If a man gets drunk and kills another person, is it murder or manslaughter".

In saying all of that,if you're drunk AND PASSED OUT,it's rape.if not and you consent at the time it's not rape.
If a girl is competent enough to take a substance that will make her more willing to have intercourse with someone, she is fully responsible for her actions while intoxicated.
What if she's drunk and agrees to have sex? That's not rape. She might regret it the next morning (or vice versa), but if she isn't being forced to have sex then I don't see how it can be considered rape.

Another screwy USA law. The law of England and Wales defines rape as:
1)A person (A) commits an offence if— .
(a)he intentionally penetrates the vagina, anus or mouth of another person (B) with his penis, .
(b)B does not consent to the penetration, and .
(c)A does not reasonably believe that B consents.
Following the ruling of R v Bree (2007) a person does not lose the capacity to consent to sex merely because she is drunk. However the defendent would have to show based on the balance of probability that she was capable giving that consent (R v Douglas [2005]). So it could be that the jury finds that she did actually consent. If this failed, then the accused could also argue that a reasonable person in the circumstances would have thought she had consented and that he believed the same.
If she is to the point where she does not know anything that is going on, or to where she is almost passed out, then yes it could be considered rape, but a lot of people have drunken sex. If guys were accused of rape for having sex with a drunk girl, then a lot of guys would be locked up.
