What happens if its in the case that it isn't natural sex. What if a gay man becomes upset with another guy to the point he beats him up and ties him to a chair and performs sexual intercourse with him, let I add that the victim is straight. There is no pleasure in this case as the guy is not homosexual.

Silly, rape and sex isn't the same thing by definition. If you enjoy "rape" then that isn't rape by definition, that is sex. And i can't say this on a guaranteed level but i don't think all sex is enjoyable. I have read that pain is experienced.

This argument addresses only cis male on cis female sexual interaction.

First, let's be clear; the question is simply about rape. It doesn't say anything about abuse, age, etc. I am going to interpret this as narrowly as possible; some sort of forced interaction with the an individual that, if the element of non consent were eliminated, would be completely legal. I will address some of the ramifications of that at the end.

Many times in life the desired outcome is not fair but equitable. Men, currently, are extremely disadvantaged in the area of sex.

Please note, I said in the areas of sex; not in the areas of physical intimidation, or in pay structures, or general privilege. However in the sexual arena there is a fair market and an intentional structural disadvantage to men. From a fair-market standpoint, speaking in generalities, men have greater drive for sex (especially outside the bounds of a committed relationship) then women. That's not to say that women don't enjoy sex, simply that that drive is stronger in men. Because of this, and the fact that men outnumber women, women hold a strong marketplace advantage over men. This is the free market advantage I mentioned.

The systemic advantage that women have is actually astounding. To demonstrate;

Consensual sex; but partners agree to use a condom for the stated purpose of not procreating. The man goes into this liaison with reasonable reliance on that. If the barrier fails, or the women causes herself to conceive in some way with his sperm (far fetched not impossible), she decides if the child is carried to term. If he is 100% pro life and considers abortion murder and she doesn't want the kid, tough shit, kid will be murdered (in his eyes). If he doesn't at all want the kid and she does, he is now a dad for the rest of his life, like it or not. If they both know they can't afford the child, she gets governmental help and he has to pay the government off. If they are both financially sound, but she decides not to work, same thing.

This structural tilt against men falls into sex as well; he is assumed to be the one responsible for them both be sober enough to give consent (not in the law but in the application thereof), and next-day-regret-turned-rape-claim is a case of guilty until proven innocent.

All that to say that to address some of the sexual inequity, sex without consent should be treated as an individual situation that ranges from an admonishment to significant civil penalties, and should be considered an aggravating factor any physical crime (battery etc.), but not a heinous crime prima facie. A situation where there is questionable consent and lack of memories due to voluntary consumption of alcohol or drugs should be treated as a life lesson. The same scenario where there is either witnesses to any sort of verbalization of non-consent, or if the female gives testimony and does remember not consenting and either A. he isn't able to recall or B. her testimony is more convincing, assuming that the fact that they were in an intimate setting together was consensual, should be treated as a civil negligence and with some fine and also a private right to action, but not with life-altering damages collected. A non-consensual encounter with no violence associated should be a severe civil penalty, with a private right to action and, if damages are proven, counseling or whatever was required should be restituted. Again, though, this should stay in the civil system, unless and until actual battery, threats of battery, or other similar criminal violations that we already have on the books take place, in which case it should actually still be civil but also aggravating in the criminal case.

In my opinion this would both make the entire situation more equitable and bring old laws that were written when sex outside of marriage was illegal into this present day.

Because...taking advantage of someone in a traumatizing and life effecting way is wrong. It is wrong because it feels wrong, and it looks wrong. This can be due to morality reasons. I surely don't want someone taking advantage of my child if i ever had one.

I am not saying all rapes end in a traumatizing way because i do believe in all possibilities. However, i have read a lot of rape stories (dark stories curious me. im weird) and assuming they are true, then rape do proposed a traumatizing effect. And i personally do not think people, men and women, have to go through that horror.

No one should be forced to do something and rape is taking away the choice of someone and can have many bead side-effects to the person being raped eg paranoia and depression. People should have a choice taking away that choice is bad in this case should I have sex with this person or not? But then they can't make the decision because the answer is forced upon then not only that its a cruel and selfish act.

I don't think rape should be legal. No one should be forcing anyone to do anything.

I do however think the laws that dictate what rape is, need to be changed slightly. I used to of know some sixteen year old girls, and that age group, that would date older men.

The men felt awkward about it and din't take them places, not because he was ashamed of being with a much younger girl, but because the law and his peers would see him as a pedophile.

If he were to have sex with her, I don't know if they did or didn't, it would be considered statutory rape. In that instance no one is beign forced but the government and thus the law don't believe one party to be of sound enough mind to make up their own decision about sex. I do believe that to be false. You'd be surprise what a sixteen year old could tell you about sex in this day and age.

Speaking off topic, I was driving home past the elementary school where I saw two kids so small I assumed they were 10, kissing. I definitely think 10 is a little young to start.
