Should UPS and FEDEX refund missed Christmas delivery costs?
Fox News reported that SEN. RICHARD BLUMENTHAL, D-Conn., urged UPS to offer refunds to customers who were left 'empty-handed' after their Christmas deliveries were delayed. Why in would a politician get in the middle of private commercial transactions? Maybe people should have ordered earlier? I just don't get it. If they were due by a certain day and not delayed by weather most companies refund the shipping costs anyway. Amazon is already giving their customers and extra $20...so I am not sure why this needs political attention...but let's give it a little morewhile we are at it!
What do you think? Should the shipping companies pay up or should politicians stay out of it?

They entered a contract with whomever payed the delivery fee. The terms were as minimal as this: first part pays for delivery, second party delivers by a determined date. If the date was Christmas and the delivery was not met, the contract has been broken and the breaking party should pay for doing so. Side: Yes, pay up

Granted, there was a contract between the receiver and deliverer by voluntary exchange, but the contract isn't breach because the receiver did agree to the Terms and Conditions of United Parcel Service of America and Federal Express with a signature. Terms and Conditions Title: 2012 ECEMEA-English ups T&C;’s Date: 31/10/11 {TC2} Interruption of Service 6. "If UPS is unable to start or continue with carriage of the shipper’s package for a reason beyond its control, UPS will not be in breach of its agreement with the shipper but UPS will take all steps that are reasonably practicable in the circumstances to commence or continue the carriage. Examples of events beyond UPS’s control are disruption to air or ground transportation due to bad weather, fire, flood, war, hostilities, civil disturbances, acts of government or other authorities (including without limitation, customs) and labour disputes or obligations affecting UPS or some other party." "Examples of events beyond UPS’s control are disruption to air or ground transportation due to bad weather, fire, flood, war, hostilities, civil disturbances, acts of government" It says in the article that a portion of the cause for the goof-ups were the companies being understaffed, unless you can point out where being understaffed is made notice of in the terms (it would be very silly for a company to put that), then the blame is still at least in part on them. I'm definitely for FedEx, because I've seen their companies in more countries and often enjoyed their services. Maybe UPS is also good, but not for me, if I have never used it in my travels. But sometimes the parcel tracking service is more important to me than the delivery service itself. So I feel safer. Therefore, I often use https://pkge.net/couriers/ups to make sure. And I completely agree FedEx never lost my parcels and always delivered on time. Side: Yes, pay up
