Should illegal immigrants be protected by the constitution?

Do you think that the constitution should also be applied to illegal immigrants in terms of criminal justice procedures and other forms of societal treatment as well?

Everyone, no matter who they are or what they've done, should have the protection of fundamental human rights. Insofar as the US Constitution is an affirmation of these rights, I would say yes.

The Constitution does not only protect human rights. Its protects AMERICAN rights. therefore you should have to be a u.s. citizen in order to receive protection from this AMERICAN document. We are not the worlds refugee camp. we are a country and should not have to protect EVERYONE!!! we can barely take care of ourselves as it is.

As long as someone is being tried in an American court, the courts still have to follow due process of law. Which is a concept laid out in the constitution. The constitution is the LAW OF THE LAND, meaning it doesn't just govern American People but it governs how our courts operate.

I'm hardly an expert on the Constitution, but my understanding is that it covers three general areas:

(1) The make-up of the various branches of government, their duties, and restrictions on their power;

(2) Election for public office and the rights of citizens to vote; and

(3) General basic rights such as freedom of expression and right to a fair trial.

Of course, (1) applies only to the government, and (2) should only apply to US citizens. But I don't see why (3) shouldn't be extended to all people.

Should the US government be allowed to do whatever they like to people who aren't citizens or who have broken the law? Should the govt be allowed to imprison them for no reason, or torture them, or sell them as slaves? Of course not. Everyone should be protected from these things, and the Constitution is the legal document that offers this protection in the US.

We are a nation of laws, and as such they should have to follow our laws, they come into our country already breaking a law and should not be afforded rights under our constitution. We cannot pick and choose which laws to uphold and which to ignore, that is shaky ground and will most definitely in the end lead to unruliness. If the support of the American people were there to change this law it would already be done, but it not..so those of you who voted yes you are in the minority!

If anyone would bother to do 10 seconds of research, then they would have the answer. If you agree with it or not, the 14th Amendment clearly states that some of the protections of the Constitution apply to anyone, regardless of whether they are citizens or not. Here is the relevant part.

No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive ANY PERSON of life, liberty, or property, without due process of law; nor deny to ANY PERSON within its jurisdiction the equal protection of the laws.

They are criminals. They broke the law to be here. They are afforded some protection under our laws but not fully protected because they are not legal citizens.

Without due process of law. Seeing how they are criminals and would be sentence to be expatriated to whatever rock they crawled from then one could deduct that after they were afforded their due process that they would not be protected under our constitution, unless they wish to apply for assylum, which guess what, they would not qualify for. So that brings us back to......THEY ARE CRIMINALS.

I think that illegal immigrants should be protected by the constitution to a certain extent. Firstly to be technical, if an illegal immigrant were found with a large amount of illegal drugs, he would be charged with a crime for violating the laws because even though he is in the country illegal, he is still considered as a human being and also an individual living within society. Secondly, if he is living within the territories of this country he should be protected by the constitution or else the government can abuse its power in dealing with illegal immigrants. And also, even though a person may be living here illegally they might still be making contributions to their communities or other places.

It's illegal though they are living so hard. They are doing something against the laws. However, if you think illegal immigrants should be protected by constitution, the government can make new laws about illegal immigrants that can protect them.

At least legal immigrants are trying to abide by our laws and that should allow them protection under our laws. Besides if they are legal, they are paying taxes just like the rest of us who work under a legal visa or social security number.

Illegal immigrants have entered this country illegally and therefore they are, you guessed it, CRIMINALS!!!!!!!! But yet as criminals they receive far better medical care than the people who were born here or have immigrated legally. All of you people who think they deserve this or deserve that, read up and see what happens when you enter mexico illegally.....if we did that to them than they wouldn't be here. The only reason we have these discussions is because the politicians want them to be able to vote so they can continue the stranglehold they have on Washington. If there was not a chance in hell that they could vote the politicians would have booted their criminal asses a long long time ago.
