The 'Double Jeopardy' Rule
This is a rule that states a person may not be tried in court for the same crime twice.

It does two things: First the obvious, law enforcement could just keep trying the same person for the same thing indefinitely until they get a guilty vertdict, so it protects the individual. Second, it encourages investigation in that, it may be too tempting to simply due the above as opposed to trying to find new evidence and perhaps another individual actually guilty of the crime if they have the option of just picking someone and trying them until they get the verdict they want. Naturally it has its flaws, since a guilty person can, and I'm sure does often, "get away with it" but human law is always going to be imperfect. I'd rather let the guilty walk than let the innocent be convicted or targeted. I think the Double Jeopardy rule aids in protecting that. It also reinforces the notion of due process by motivating the prosecution, including police and experts to collect the data appropriately and accurately. 322 days ago | Side: For

If new evidence crops up, then why shouldn't someone be tried again? A murderer may get away and kill loads more people if they are not prevented and if this rule does not apply. With this rule, as long as someone can get through the court case and protect any information, they are okay because they cannot be tried again. 322 days ago | Side: Against
