Left-wingers railed against Trump for his enforcement of the law at the border. When he capitulated with an executive order, left-wingers sued him.
While in custody during their due process, parents will either be held with their children or separate from their children. With objections to both options, the only alternative is to not detain parents during the process, which effectively creates an open border policy for the 40% of border crossers who do not respect our judicial process enough to stick around for it.

We must either detain them or not. There is no alternative.
We currently detain offenders (adults) to conduct the investigation, otherwise we are unlikely to locate them should they flee, which 40% of them do. The investigation doesn’t take long unless they claim asylum. If they claim asylum at an authorized point of entry, their intentions are considered honest and they are not detained for the investigation.

First, yes we do. You are detained every time you are pulled over by a cop. When you sign that ticket, you bond out of jail on a promise to pay or go to court. If you refuse to sign, a cop may arrest you to ensure you go before a judge. There is no crime less serious than a minor traffic offense.
Second, if a person is attempting to cross illegally more than once, it’s a felony. But officers cannot know that unless they conduct an investigation. They either detain them for an investigation or they do not. Which is it?

I don’t. Neither do I want them to break the law and require tax resources to conduct the investigation. I wish there was some kind of way to keep people from breaking a border law. I wish there was some barrier to entry that could be put in place so that we could use less resources. If only someone had some idea for something like that.

It’s not unlimited. It’s for the duration of said due process. Which is not usually very long.
Try shoplifting and then don’t bond out. See how long you’re locked up before your due process in court.

So they would arrange for some other family to care for them or human services would house them. Just like at the border. Yes, of course people will find a way to break the law. But preventative measures reduce instances of law breaking. You want to pretend you aren’t for wide open unsecure borders, even though you are against securing borders or arresting criminal border crossers.
You want to pretend that all the border crossers are asylum seekers. You said if they claim asylum, they shouldn't even be arrested in the first place. As I have already explained, people who come to border patrol stations and claim asylum have not broken the law, and they are not arrested. But when MS13 is coming in across the desert, and we catch them, you want us to let them go just because they say they are asylum seekers. That’s not ok. Even if they are trafficking child sex slaves that they claim is their family, we should still hold them and investigate. Or don’t you care about human trafficking at our border?
Just like any other law enforcement investigation, people are arrested when there is probable cause that a crime has been committed. We absolutely have probable cause when people illegally cross the border and we absolutely should arrest. Which leads me to my other question that you refused to answer:

If yes, then you are calling for a no arrest policy on all crimes that are equal to or less than a low level federal felony, since that is what all border crossers are potentially engaged in (if it’s a subsequent offence). That’s lawlessness con. In a nation of laws, it’s un-American. But then, if you answer was “no”, then presumably you only want to let a specific class of people go un-arrested for potential felonious activity. That too is un-American.
If we had some barriers, then less families would be putting their children in such danger by trying to cross illegally. Less farmers’ daughters would be sold into slavery on American soil at the hands of cartels. Less working families would be enslaved to coyotes on American soil. Border security is an anti-human trafficking measure. But neither you nor anyone of your political mindset is interested in securing our border. Nor are you interested in enforcing our laws, at least not equally. What you are interested in is an unsecure, open border policy. You’re just too chicken shit to actually say it.

People at the border who cross at unauthorized locations give officers probable cause to arrest on two counts. No matter where you are in the country and no matter what your immigration status is, YOUR KIDS DON't GO TO JAIL WITH YOU.
If we don't like border enforcement policies, then we need to change it with legislation, but Dem Schumer is against a solution. The other option is for people to STOP BREAKING THE LAW. The other legal matter in question is probable cause. "There is probable cause if the facts support an objective belief that the person to be arrested has committed a crime"
Officers can clearly observe when someone is crossing at an unauthorized border location. Officers can easily determine when someone is not immigrating through legal means. When either or both of these are observed, offenders are placed under ARREST on PROBABLE CAUSE of a crime. If they are a legal immigrant crossing at an unauthorized location, they are arrested and eventually fined. If they are an illegal immigrant crossing at an unauthorized location, they are arrested, fined, and/or imprisoned for up to 6 months. If it is a subsequent offense, it is a federal felony and punishable with imprisonment up to 2 years.

The issue of immigration is not crossing the border as a law restricts this action. It is the attempted murder which may take place as a result of the undocumented crossing. Residency in home states comes with inoculations which prevent and limit any possible outbreaks of illness. Where an agency may wish to only enforce the minor of several crimes there is more than one crime which can be used in judicial separation.
United States Constitutional equality is found under legal precedent as well as basic principle. Where basic principle may say allowing people liberty to seek refuge across borders for many reasons it is the legal precedent set by states and inoculations and medical care which add limits by law.
