Punishment should be to the degree to discourage crime depending on our priority to discourage that said crime. Discouraging murder should be a higher priority that discouraging theft, thus punishment for murder should be more extreme then theft. In a way that is crime fitting the punishment, because of how much a crime should be discouraged the more punishment it requires.

For crimes involving theft, I think the court should allow the victim to take away anything he wants from the thief.
