No. Prosecutors don't exhonerate. They prosecute. He did neither. Sounds very much like what you are saying is: "Can't prove it, never happened, ner ner ner ner ner." If I recall my days in middle school (i.e. where this argument is popular) correctly, the person using it knows he is guilty, and is confident enough in his belief there is no evidence to prove otherwise, to goad everybody else in the playground into wanting to punch him.
