My friend sent me this earlier today.  IRS tax topic 357, which is pretty clear in its title. 

 

Thoughts, feelings, and reflections are welcome.

 

I'm just curious as to how much this is actually used.  (Obviously enough to have it be a topic)

Well what does it say about our society when we have tex forms for when your kids get nappped. i mean seriously, you et your kid stolen, and you have one more form to fill out for taxes, that is soo fuckin messed up, but at the same time its kind of funny, cant really feel bad

I have no problem with that. I think the idea is that the parents would still be assuming that the child will be found, and so would presumably continue living in a home with an extra bedroom, saving for school, etc.

I mean, what are you going to do? Tell them no you don't have a kid anymore, the bastards gone? No, it's the right thing to do, even though most kidnapped kids are never found, sadly.

But the kidnapped by a family member clause is odd, because really until the child is found, how could the police rule this out? Most children are kidnapped by family members. I think that part should be eliminated.

What is this, some kind of consolation from the government?

If someone's child is kidnapped, they are obviously not dependent on the parents anymore, so why do they count as dependency exemptions?

I like how they state that the child must be "presumed by law enforcement to have been kidnapped by someone who is not a member of your family or a member of the child's family..." I'm sure that must have happened all the time. And I can't even tell if I'm joking there, sadly.

Wow, there are a lot of kidnappings that are conducted by a member of the family. Even if it seems wrong, it happens. The confusing thing is that what do they call that then? Not kidnapping, but the child was "borrowed"? idk :(

Average child credit is around 3k

I think paying someone to kidnap your kid would run you closer to 10k

so financially it would not make much sense, unless there was a large life insurance policy on the child.

Plus, you cannot assume criminal activity before the fact in any laws. People need to be presumed innocent. I would be more worried about life insurance policies on kids, than on this small tax write off.

If a child resides with you for more than half the calendar year you can claim the tax credit ( kidnapped or not). So it seems to me that the government is trying to get a loop hole for the ones taken by family.

And thus the governments are behind the kidnapping! It all makes sense!

No but seriously, that's just wrong. The government is supposed to protect the people, not try and cheat the people. Though it does seem trivial since the government has to state something so specific to lessen the money loss.
