The death penalty does not go against the 8th amendment. It saves lives, ensures justice and is a successful crime deterrent.

Death penalty is effective as it can act as a crime discouragement. If a criminal commits a serious crime and immediately is executed in front of the public, other potential criminals would start to fear of consequences and would think before doing. In this case, the death penalty is a gain, unless the convicted murderer is valued more highly than that of the unknown victim, or victims (Carrington, F., l978). Petitioners Ralph Baze and Thomas C. Bowling, whom murder and sentenced to death in Kentucky state court, filed a lawsuit stating that the lethal injection violates the Eighth Amendment’s constitutional ban on "cruel and unusual punishments.” The state trial court upheld it as constitutional. Later, the Kentucky Supreme Court affirmed, holding that the lethal injection protocol was substantially safe from "wanton" and "unnecessary infliction of pain," torture, or "lingering death." The Supreme Court affirmed the lethal injection protocol as constitutional.

2001-2011 there have been over 35 murderers that have murdered again.

The Death Penalty is most definitely a crime deterrent, because as many citizens viewing the execution realize that being taken away from this world because of wrongdoing and repeat of offenses, they will not go against the law and think rather than do.

The death penalty in most cases is against the 8th amendment. It does not save lives because many people on death row are innocent, also the death penalty does not teach criminals to whats right and whats wrong. Some criminals psychologically may need hard. Also in the case of Larry Griffin Vs Missouri, Larry Griffin was executed because the court sentenced him to death. After his death it was proven that there was not enough evidence and due to those reasons charges should be dropped. The conviction was based on a testimony from another criminal Robert Fitzgerald who was present at the murder site at that time. He said that there were 3 (black men) at that time and he saw Larry shoot. Robert was promised a smaller sentence for making the testimony. Also it was stated that Larry shot from his right hand even though larry is left handed. Larry’s attorney did not fight this is court, he also did not bring other alibi witnesses to the stand. He also failed to show there were two witnesses that confirmed Griffin did not commit the crime. There was absolutely no proof of Griffins fingerprints on the murder weapon or the car. In 2005 there was a professor that reopened the case and proved Larry Griffin innocent.

The death penalty removes criminal, and saves live in the end. 76.6% of criminals are repeat offenders. Also, at least 35 murders went on to murder again from 2001 to 2011.https://www.nij.gov/topics/corrections/recidivism/Pages/welcome.aspx

In most cases, matter of fact, the executioner executes the offender with lethal injection. That is a safe and painless way to go, because it only takes up to 30 seconds, and does not hurt the criminal greatly. To add on, the case you have written was ONE case out of many that are proven correct. And no, not many people on the death row are innocent. Most of the time, the criminals are put into jail for breaking a law. Once they have repeated the crime, they will be sent to death row. Many of the people that have died, are killing a generous amount of innocent people, meaning they deserve to die.

Furthermore, the death penalty saves lives and reassures victims. Hugo Bedau (1982) claims: The execution of the innocent believed guilty is a miscarriage of justice that must be opposed whenever detected. But such miscarriage of justice do not warrant abolition at the death penalty. Unless the moral drawbacks of an activity practice, which include the possible death of innocent lives that might be saved by it, the activity is warranted. Most human activities like medicine, manufacturing, automobile, and air traffic, sports, not to mention wars and revolutions, cause death of innocent bystanders. Nevertheless, advantages outweigh the disadvantages, human activities including the penal system with all its punishments are morally justified ( p. 323).

Many victims or the victims’ families are still scared knowing that when this criminal is finally released they could repeat these offenses. If the citizen is finally put to death, that could relieve victims and their families and many others whom have fear of BECOMING a victim, then the death penalty is considered good.

The death penalty is quick and painless. The execution only takes 30 seconds.

Side: Yes to the death penalty
2 points

Yes, most of the time it is very painless and safe. Lethal injection takes only about 30 seconds until the executed person dies. The process of it is how there is a needle in you, and a dose of IV is first inserted. Then, lethal drugs are inserted into the tube, and there is a heart monitor connected to the person, to be able to notice if the patient is dead or not. It does not fall under cruel and unusual punishment, as many states use this method of death, as it is painless compared to the execution chair, fire squad and being hung.

How would you suggest the death penalty as cruel or unusual punishment?

Because it leads to the death of someone who would otherwise be a threat to society? Or is it the type of death you are debating?

I am on the fence about the death penalty. On one hand we know for a fact that several people who have been killed because of it were actually innocent. On the other, it has permanently removed those whose very character and actions were deemed too horrific for society.

I think if we know beyond a reason of a doubt that someone did something so horrific that the best course of action is to kill them, then it is acceptable. Otherwise, they should be given life in prison.

Not only does the death penalty eliminate cruel and unusual people but it also saves us money. In not using the death penalty we are no longer paying the taxes on people who have murdered etc to sit in prison with a bed and warm food.

- Sometimes when people are on the death row scientists try new drugs on them to make them die instead of the classic drug that they use.

- many people say this is bad because they are used as test dummies for science experiments but on the other hand they are about to die so there is no point in getting a perfectly brand new human to test on when the other is about to die.

-Clayton Lockett was used as a test dummy to test out some new drugs which was a mixture of many.

-The death row is a very good thing because it saves taxpayers a lot of money.

-It costs on average 120,000 dollars to house one inmate in america which comes out of the tax payers money. 1,800,000 is how much it would cost a taxpayer to pay for an inmate for 15 years which is the amount of years it takes on average for death row.

-This is a huge waste of taxpayers money when they can just kill the person straight away.

-Wayne Smith was put onto death row in 1994 and recently died in 2017.

-over those 23 years it costed about 2,760,000 dollars to house him for those 23 years which is a complete waste of money.

Hameed, you cannot bring finance into an innocent persons life. Just because some thing is saving money you cannot take a life of an innocent person or you cannot give an unlawful punishment. Many people are executed because there not enough evidence thats admissible in court. In those situations people get death penalty's because they cannot be proven right. Motions to dismiss should be filed and innocent people should be free instead of on death row. Furthermore, the death penalty is very expensive to execute, and in most cases is more expensive than a life time imprisonment. So as the death penalty is no use as it teaches you nothing and it is also more costly. The death penalty costs 2.3 million dollars for 61 executions and for 313 people it cost 1.4 million

Some offenders are not scared of jail time or dying of old age as an inmate. Many criminals would have a fear, as they watch other criminals repeating the same offenses that the current criminals are thinking of doing or have done at least once, and stops them from doing those crimes. The offenders that constantly violate the law and have a background of wrongdoing deserve the death penalty as justice and to save many victims.

“Within three years of release, about two-thirds (67.8 percent) of released prisoners were rearrested. Within five years of release, about three-quarters (76.6 percent) of released prisoners were rearrested. Of those prisoners who were rearrested, more than half (56.7 percent) were arrested by the end of the first year."

If these criminals are killed and not psychologically helped then other criminals may also do the same thing. Criminals dont need to be killed, they need help. So many people are brain washed and they think death is the right thing for them. Others may follow their footsteps. Instead of release those criminals should have been helped.

To conclude, the death penalty is humane because of the method, and follows the constitution as a majority of the deaths are painless. It deters crimes and prevents more crimes being committed over and over again. Because of the death of ONE criminal, many actual innocent people have the right to live as they are now prevented from murder.

Furthermore, There are cases of when people were not guilty whatsoever, and even though there was a lack of evidence against them, and they were completely innocent, they perished nonetheless. An example of this is found in the case of Cameron Todd Willingham. In Texas, 1992, Cameron was convicted of conducting an arson murder on his three children, and setting their house on fire. However, he was not given a fair trial, violating his 6th amendment, and there was a lack of evidence that supported the crime. For instance, the evidence concluded that there was no Arson present when the house was ablaze, thus concluding that the fire was accidental. In Spite of all of the evidence that he was innocent, Cameron still faced the capital punishment, and was killed.

He was a thief meaning the only punishment he should have got was several years in prison but he was sentenced death because he accidentally fired a gun(by falling down on it) and killed the owner of the house. This should sentence him to 50 or a whole life in prison not death penalty.

This also means that amount of taxes paid is also increasing. This problem with taxes was found in the states; nebraska, indiana, washington, pennsylvania, nevada, kansas, idaho, colorado, california...This proves that the death penalty isn’t good for the criminal nor the citizens.

The tax for housing the inmates in jail should be almost the same amount. Imagine having to pay for water, food, beds, and clothes for each new inmate that comes into a jail. Now, imagine having to pay for housing them, for a LIFETIME. In addition, Zaid, from your group, claimed that we need not bring finance into a person's life, therefore, if they deserve to die, the cost would not be important.

The eighth amendment says that cruel and unusual punishments are prohibited. The death penalty is one of the punishments that can be given for a crime. We believe that the death penalty shouldn’t be allowed because in several cases, innocent people get killed because of death penalty. The death penalty doesn’t help a person develop, and makes a person unable to learn from their mistakes. The Death Penalty is mainly used for criminals that repeat offenses. If a crime committed is too serious to be put into jail or rehabilitation, then they execute the offender. Most of the time, death penalty serves justice rather than mistaking the offender. Although it is more expensive, it is rarely done considering jail time is more evident than executions. If a criminal has too many wrongdoings and is proving himself worse and worse in the world, they can do nothing else but take them out of it.

The 8th amendment says that “no one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment.” In the US, there are 5 types of executions which are currently used throughout the state's, lethal injection, hanging , gassing , firing squad, and electrocution. These options are all seemingly painless and lead to a quick death. However, many mishaps can happen causing agonizing pain beyond belief. The case of John Gacy is a great example for why these methods should be banned. John Gacy had been given the lethal injection, and the job should have killed him in minutes. However, the sedative worked incorrectly, making him unable to breathe. He gasped for 18 minutes, in great pain , before perishing.

I agree with what is said here, 7 Inmates In Guantanamo Bay are on death row such as Mohammed Ramadan, this is totally against the law of the United States. This is because these inmates are tortured and killed. Most of the inmates in this camp do not have the right to a trial or the right to a attorney. They are captured from different countries and are illegally thrown in Guantanamo Bay. This violates the miranda rights because you don't have an attorney. This violates the 6th amendment as you did not get a fair trial and also the 8th amendment as you are getting a punishment of death without proof. Also the military cannot execute someone without approval , John A Bennett was executed without the approval. This shows how the United States is not following laws and is completely unfair.
