I see both sides but I'm voting this side because possession is 9/10 of the law. If a pedestrian is standing directly in the space, making safely pulling into the spot impossible, than the spot is out of play as long as that pedestrian refuses to move. Sure you could keep blocking the other car it is being held for from pulling in but all that's going to do is waste everyone's time. But as soon as that pedestrian moves then anyone could take it. It would be different if someone simply put a homemade sign by the space but did nothing to physically stop anyone from parking there. Then absolutely you can go ahead and take it. Then the other gray area is snow clearance. In congested big cities it is a tremendous effort to dig out parking spaces from giant snow plow banks. After someone spends an hour doing that they should be able to temporarily mark it (with a chair or something) until they can sit in their car and pull into it. Letting any random person immediately take it would be a major disincentive to anyone volunteering the labor. However, the person who cleared it needs to quickly put it in use. They shouldn't be allowed to leave the chair there for days on end while they repeatedly come and go with their car as they like. Side: Yes, first is first!
