He was sued by the state the first time. If they did it twice that would be discriminatory. But he was sued by a private person the second time and for something slightly different. The third is by the same private party, but it won’t go anywhere in the courts if it’s not a new issue. While the private party may be doing it for activist purposes, we can’t block people from using the justice system.

Your question is, Is this now a hate crime? The answer is no. There is no crime. He is being sued by a different person for something slightly different than before. A person is using the legal system, legally, to try to seek the justice they perceive they are due.

It's not moving targets, it's knowing what a hate crime is.

Season 4 Episode 6 of “Southland” aired 2/21/12. A few months before the Colorado cake shop incident. The officer who explains the cake shop owners rights is a homosexual character. Kind of ironic.
