The answer depends on your definition of "harmful to others". If you are refereeing words that hurt someone's feelings, well that's not a reason to prosecute a person. Especially that nowadays, it's become trendy among certain groups to invent new "offensive" catogories of speech which "hurt them". However, lying in court is an example when "free speech" can be a crime. Or, consider a situation when there's a leak of chlrorine trifluoride at your factory, but you "freely" tell your employees that it's OK to work there. Such freedom would probably get you convicted to a life sentence in prison. Side: harmful things cannot be said

so long as the statement is not a call to action, then it cannot be harmful. the first amendment freedom of speech (for America) does not cover calls to action. - you cannot tell people to riot. you cannot tell people there's a fire if there isn't one. you cannot tell people that there is a bomb at a location. - these are harmful things, but they are a call to action. sometimes a false one. they are done to get people to do somthing. if your words do not tell somone what they should do, the speech is legal. - "Burn theses bitches down" should not have been protected. the full "We have nothing to loose but our chains" chant should not be protected, as it says "We Will fight" which could be seen as a call to action. - Savy? then it is on the listener to deny that possible call to action. if we get into implications then merely a few statement of facts could be seen as implication. - For example = It is a fact that african americans are statistically more likely to have a criminal record. It is a fact that criminals should be arrested. = this implies nothing, but to some, more sensitive audiences, it could possibly imply that I think that Most blacks should be imprisoned, and by transit my listeners should put them in jail, which isn't the case. it is right that we should not speak bad about anyone.. but in case to defend our-self.. it is just. we can not say that speech is harmful just because of some people misusing it.freedom of speech is must and everybody should get chance to keep their statements.it leads to growth of a society,not harm! I disagree, because I don't think suppressing the hateful things people say in any way protects human rights, it does the opposite. It allows those thoughts and feelings to go under the radar, potentially to explode later as something much worse than hate speech. The only way to deal with hateful thoughts is to get them out in the open and talk about them, and compare them to the rest of their peers who are moderate or feel exactly the opposite. Freedom of speech should be held paramount - it is a prerequisite to all other rights. Now, if someone says something which intentionally gets someone hurt then they should be punished for the crime they caused - but there should be no punishment for speech, it doesn't matter what was said.
