If someone has sex with a girl who consents to sex while drunk, why can they in trouble?

In my opinion, the girl had no business consuming a substance that makes her act irrationally, and consequently, she is responsible for any decisions she makes while under the influence. Yet, guys can be considered rapists if they do this. If you drink and drive you are responsible for your actions, so why do we treat woman like children with regards to them getting themselves drunk?

It's absolutely undeniably a double standard that the man can get in legal trouble for sex with a drunk woman but the reversal is not true for a woman.

But with that said, the majority of sexual abuse is indeed men upon women. Plus a responsible intelligent man isn't going to put himself into the type of situation which would lead to such a serious misunderstanding.

Both people are in the wrong. Morally. However, the girl consented, even if she was drunk. Thus, the guy shouldn't be considered a rapist.

if they knew she was drunk when she consented then they could be considered a rapist because they knew she wasn't herself when she consented. being drunk makes you not able to think things through before you do them. being drunk makes you impulsive and different then you would normally be.

By that logic people shouldn't be responsible for drunken driving and drunken fights. Because after all they were intoxicated and weren't themselves right?

Even idiots know that, when drunk, your ability to make a clear judgement on a situation is severely hindered. Therefore, if someone was to ask a drunk person whether they wanted to be pushed off a bridge and the drunk person said yes, would that be deemed morally right for the able-minded person to push them? No, that's what I thought. When a person is drunk, REGARDLESS OF GENDER, if they 'consent' to something, it should NOT be taken as consent, as this person is unable to think clearly and therefore cannot judge whether they want to have sex with the person. This happens to men too and, unfortunately, it isn't treated as such as serious crime but it SHOULD BE. Regardless of gender, if a person has sex with a drunk person who has apparently 'consented' they are a rapist. Sex is only consensual sex if the person is able to make a clear decision and, if they are under the influence of alcohol, they won't be able to do that.

EXACTLY. If so, WHY IS ALCOHOL LEGAL AND EASILY ATTAINABLE if to causes people to do such stupid things? Yet less dangerous drugs are totally illegal.

Alcohol can:

1) Kill

2) Cause mood swings

3) Impair judgement and focus

4) Cause withdrawal symptoms

5) Causes cancer

6) Is addictive

7) Can cause blindness

Marijuana causes none of these, and yet it is illegal.

That has been an arguing point for years. While marijuana has been proven to be beneficial in medical usage (stops seizures or minimize them, reduces severe pain), alcohol hasn't shown many medical uses. Makes you wonder who is paying who to keep marijuana illegal. Probably the pharmaceutical companies that want their expensive drugs pushed.

they can still be in trouble because she was not herself while consenting because she was under the influence and not able to use proper decision making skills.

She shouldn't have been under the influence in the first place. If a substance makes you behave differently, it is a dangerous drug and should be illegal. If another drug that was smoked had the same effects as alcohol it would definitely be illegal.

Everyone should know being in a drunk state people lose the inability to communicate with a clear conscious mindset. Don't take advantage of a girl knowing the state of mind she's in, even if she consents to sex. If you were a good person you would understand that she's in no position to speak for herself.

Yes, this makes sense. However, in reality, she shouldn't be allowed to consume a legal drug. Her doing so, makes her sacrifice a lot of her defenses.

If someone is drunk and gets in an accident they are held responsible. If someone nis drunk and beats someone they are held responsible. So why should it be different with sex? Regret doesn't equal rape. Also how come when a man is drunk and the woman isn't it's fine? It's purely a double standard.

There is a word which we use called maturity and if one is mature then they understand the difference between being responsible and being irresponsible. Can we not as adults find it quite easy to take advantage of young children? They aren't even under the influence of any kind of barbiturates but we could tell them to run this bag of drugs across the street.

When we take advantage of someone who is at that point in time this advantage would we accept the same treatment done to us? How about entering into a financial contract where the person who drew up the contract doesn't let you know that the percentage you'll be paying back will balloon to three times as much down the road, is that fair because you did sign the contract?

People who get in a car drunk are held responsible. People who get into fights while drunk are responsible. People who do things while drunk are to held responsible for their actions while intoxicated. But when a woman is drunk and has sex she isn't held responsible. It doesn't make sense to have this double standard. This is literally the only situation when someone is drunk and not held responsible for their actions. Regret does not equal rape. Consent is consent.The woman is drunk and should be held for responsible for her actions as she would be if she got into a car or something of the sort.
