Opinions on Three Strikes laws?

   Three Strikes laws are laws designed to impose radically harsh sentences on criminals who commit their 3rd felony. 28 states, over half the country, have some form of Three Strikes laws. The idea behind them is to keep what the states call "repeat" or "persistent" offenders imprisoned for a much longer amount of time, since they've been deemed likely to commit again. Such laws have faced extreme criticism for cases such as:
   Rummel v. Estelle, Tx 1980 - Court upheld a life sentence on Defendant William James Rummel upon being found guilty of his third felony. Said felonies are, in chronological order; fraudulent use of a credit card totaling $80, passing a forged check worth $28.36, and refusing to return $120.75 received as payment for air conditioning unit repairs the payee cited were performed either unsatisfactorily or not at all. All three were technically felonies, the first case sentencing him 3 years, the second 4, and the third life in prison.
   In some states, minor felonies are considered in Three Strikes laws; meaning in California, for example, stealing golf clubs three times will land you in prison for a life sentence with a minimum of 25 years prior to becoming parole eligible; as is with every state enacting Three Strikes laws.
   What are your thoughts on these laws and opinions on whether you believe they're a just deterrent to habitual offenders?

Such laws are too lenient.

In the old wild west they used to hang horse thieves, not for stealing horses, but to deter people from doing so.

Most cops who catch those breaking the speed limit don't exercise their discretion and let them off with a caution, as they know most people speed regularly every day and this happens to be the rare, or first time they've been caught.

In my opinion most people who commit crimes make a habit of doing so.

It should therefore be recognized that a lawbreaker who may have been caught committing their first offense and treated with misplaced clemency shall become emboldened and reoffend, as all such low lives have inherent criminal tendencies.

Justly or unjustly, fairly or unfairly, this should be the assumption of the Judge when he/she is imposing their sentence.

I agree with parts of your argument; however most would disagree with A) bringing back hanging execution and B) executing over any felony.

I do agree that most cops are too lenient over speeding violations in particular, partly because it is a regular occurance and most cops who are lenient likely speed themselves even when off the clock.

I disagree with your statement that argues both clemency creates reoffenders and those same people inherently hold criminal tendencies.

I believe the core problem is with how children are raised. I think requiring expecting parents to become certified by passing parenting classes would do a lot of good with the crime rate and level of ignorance in America.

I have two cousins, the younger of whom was, from the ripe old age of three, a real tearaway, while the other, who was no Angel, was more normal and didn't show any congenital signs of criminal behavior.

Obviously both children were reared by the same parents in the same family environment.

His parents who were decent, well educated, law abiding, God fearing citizens, (his father was a well respected, highly decorated, D.F.C., WW2 R.A.F.,war hero), tried everything possible to tame their tearaway son but to no avail.

The younger of the two ended up being the leader of a notorious Belfast based Loyalist paramilitary organization which was responsible for many deadly crimes. Check out;- The Shankill Butchers.

All the psychological therapy and professional counseling was a waste of time on this individual as his inherent diabolical barbarity formed the foundation of his personality.

If this murderous scoundrel had been locked up indefinitely from an early age at least 20 plus people would either be alive today or would have died from natural causes.

I observed the brutal viciousness develop in the younger of my two cousins who brought shame and disgrace to everyone with whom he was connected including his wider family, while the older boy became an astute businessman and an asset to the community in which he lived.

In instance where things were minor, such as the examples you gave, I think life in prison in exorbitant. However I could also argue in cases of Drunk Driving, there has to be something like this. If they continue to make bad choices and are a danger to others, there needs to be much harsher punishment. I don't know about life in prison but I think ultimately it is going to depend on the crime.

For certain crimes certainly not ,the crime of rape , peadophillia and attacks on children or the elderly should ensure a life spent in a gulag type regime where the guilty are made to work 16 hours a doing the most back breaking work possible , I would also keep them on minimun rations and eventually they should hopefully die from a slow well deserved death

Filth like the above deserve absolutely no sympathy from society and their heinous crimes cannot be rationally defended by bleeding heart type idiots who bleat on about forgiveness and councilling
