Capital Punishment at best is only cruel punishment. It cannot qualify at all as unusual punishment every one who lives will also in fact die. Most accidental deaths, or death from illness are dealt to us by fate as punishment for behavior. Why many standards of cruel are based on the conditions set by a persons conduct. What is cruel to one persons standard of actions may not be cruel to another's. By Constitutional principle we are taking about Capital Punishment. Side: no way

Murder is the unlawful killing of another human being. Since this death is being achieved by law itself, how exactly is it murder? Jesus Christ, are you retarded? So basically you are saying you have absolutely no moral problem with killing provided the state tells you it is OK? The irony is that it is exactly people like you which the state needs to execute. The death penalty is no more or less unjust than jailing itself. The three unalienable rights are Life, Liberty and Persuit of Happiness. If Jailing people normaly takes away two of those three rights and people claim in just, than taking away the third right as a last resort punishment should not be anymore unjust than taking away the other three. While it is true that the death penalty is costly, that has nothing to do with the moral issue that we are disscussing here. While the penalty should be dealt with delicatly due to cost- this does not make the death penalty unjust. Only that we need to be careful with whom we chose to eliminate. As an example, Bin Laden was a man who needed to be killed- he served no good in this world. Also you fail to explain "that although they deserve to be punished, the death penalty is not right." It was a weak statement with no clarification or justification. Side: NO WAY

In the spirit of things, I will refute you. If unalienable rights cannot be taken, then how did their victims right to life get terminated? There are many things that are cruel and unusual, but perfectly legal. Shoving old people into nursing homes, bull fighting, etc. and society watches as these things happen. Side: NO WAY
The United States has an eye for an eye policy against people who do some of the worst things imaginable. What if someone you knew was kidnapped, raped multiple times and finally killed. That person does not deserve the right to live. If there was anything unjust about our Capital Punishment system is that we let these people spend 15 years making useless appeals. I admit that there is flaws in our current method of execution (Lethal Injection) due to a lot of these people have bad veins. Because they have had a history of IV drug abuse. We should bring back hanging and that should end the "Cruel & Unusual Punishment" argument that takes up too much time in the US Supreme Court. Side: NO WAY
What if someone you knew was kidnapped, raped multiple times and finally killed I'd be sad but I would not let hatred control me. If I have compassion with my love one, I had compassion also with the inmate. Let just say, the inmate is out of his mind and he needs rehab.
