The court should act in the best interest of the children. This will include assessing the violent act. The questions would be: Is this act evidence that she could be violent towards the children? Was it an isolated incident? Have the children suffered psychological harm as a result of this act and is there a risk of this occurring again in the future? A guardian ad litem would be appointed for the children. The children are of an age in which their opinion on who to live with should be given weight. It is usually the case that the mother is assumed to be the most appropriate carer for the children. This is a sad fact.
