He should be voting based upon the opinions and feelings of the people he represents (hence representative) while respecting the permissions granted from the constitution. The idea is that the supreme court shouldn't have to review every bill, but the senate and congress should do their best to pass constitutional laws and be weary of the check that the judicial branch holds.
In the case that the supreme court OKed a bill then he would support it because it would be authorized by the constitution still. The supreme court does not pass bills, it only has judicial review over them.
