Um, some people are born evil. For example, some are born as psychopaths who just so happen to like killing people. But the rest that aren't born sadistic are just neutral. It all depends on how they were raised, their environment, etc.

Simple. If a man was proven with hard evidence and facts that he killed a person, then he gets the death penalty. An eye for an eye.

I support both strength and intelligence. I feel like you need both of them to be superior in every way. So, I think strength is as equal to intelligence. Think of it as survival. You're stranded on an island with little supplies. You need both intelligence and strength to have a higher chance to survive. Intelligence is for your resourcefulness and strategy so you can find food, build a shelter etc. Strength so you can defend yourself against predators who seek to kill you and to have physical toughness against harsh conditions. If you lack intelligence, you won't know what to do and you'll end up dead from not finding food or building a shelter to rest in. If you lack strength, you'll be killed from the predator or you wouldn't have the physical toughness to survive the harsh conditions. All in all, having both traits is better than having one. But if I had to choose one, I guess intelligence would be more important.
